These Exit 7C Terms of Service (the “Terms of Service”) describe the terms pursuant to which Exit 7C Inc. (“Exit 7C ” “we” or “us”) offers you access to the Exit 7C website located at www.exit7c.com as well as other localized Exit 7C websites and the services and tools (including, but not limited to, mobile and other software applications) related to the Sites (collectively, the “Service”). These Terms of Service apply when you access, visit or use the Service.
DISTRACTED DRIVING AWARENESS. DISTRACTED DRIVING IS VERY DANGEROUS. ALWAYS DRIVE IN ACCORDANCE WITH TRAFFIC LAWS AND IN A MANNER THAT IS APPROPRIATE AND SAFE FOR ROAD AND TRAFFIC CONDITIONS. ANY INTERACTION WITH THE SERVICE WHILE OPERATING A MOTOR VEHICLE IS STRICTLY FORBIDDEN. ANY PRICE UPDATES OR OTHER INTERACTIONS WITH THE SERVICE SHOULD ONLY BE SENT WHILE YOUR MOTOR VEHICLE IS NOT IN MOTION AND IN A LOCATION PERMITTED BY LAW. PASSENGERS OTHER THAN THE DRIVER MAY INTERACT WITH THE SERVICE WHILE THE MOTOR VEHICLE IS IN MOTION, PROVIDED ANY SUCH INTERACTION DOES NOT DISTRACT THE DRIVER’S ATTENTION FROM THE ROAD OR TRAFFIC AND DOES NOT INTERFERE WITH THE DRIVER’S OPERATION OF THE MOTOR VEHICLE.
Notice Regarding Dispute Resolution: These Terms of Service contain provisions that govern how claims you and Exit 7C have against each other are resolved (see Section 14 (Limitation of Liability), Section 19 (Choice of Law and Forum) and Section 20 (Arbitration Agreement and Waiver of Class Action Remedies) below). It also contains an Agreement to Arbitrate (see Section 20(A)), which will, with limited exception, require you to submit claims you have against us to binding and final arbitration, unless you opt-out of the Agreement to Arbitrate in accordance with Section 20(D). Unless you opt-out: (A) you will only be permitted to pursue claims against Exit 7C on an individual basis, not as part of any class or representative action or proceeding and (B) you will only be permitted to seek relief (including monetary, injunctive, and declaratory relief) on an individual basis.
YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. IF YOU DOWNLOAD ANY CONTENT FROM THE SERVICE, YOU DO SO AT YOUR OWN DISCRETION AND RISK. YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY CONTENT THROUGH THE SERVICE. WE RESERVE THE RIGHT TO RESTRICT OR TERMINATE YOUR ACCESS TO THE SERVICE OR ANY FEATURE OR PART THEREOF AT ANY TIME. THE EXIT 7C PARTIES ASSUME NO RESPONSIBILITY FOR THE DELETION, MIS-DELIVERY OR FAILURE TO STORE ANY CONTENT OR PERSONALIZATION SETTINGS.
Exit 7C does provide content owners with the ability to notify Exit 7C if they believe that their work has been used or shared in a way that constitutes copyright infringement. Copyright owners and their authorized agents may submit Digital Millennium Copyright Act (DMCA) notifications to Exit 7C as set forth below. When we receive a valid DMCA notification, we will take down the applicable material and take reasonable steps to notify the user who posted the material. If the affected user sends us a valid counter-notification, we will restore access to the material unless we receive notice from the copyright owner that it has filed suit seeking a court order to restrain the alleged infringement, in which case, pursuant to the DMCA, access to the material will not be restored absent a court order.
You must provide notification of claimed infringement to Exit 7C’s designated Copyright Agent by mail to Copyright Agent, General Counsel, 725 Keystone Park Dr., Suite 102 Morrisville, NC 27560 or by email to firstname.lastname@example.org. For clarity, only DMCA notifications should go to the Copyright Agent; any other feedback, comments, requests for technical support, and other communications should be directed to email@example.com. You acknowledge that if you fail to comply with all of the requirements described in this DMCA Policy, your DMCA notification may not be valid.
If we receive a notification, we will send a copy of the notification to the user who posted the material addressed by your notification.
When we receive your counter-notice, we will forward a copy of it to the person who filed the original copyright claim. If we do not receive notice within ten (10) business days that such person is taking further action, we may restore your content.
The parties understand that, absent this mandatory provision, they would have the right to sue in court and have a jury trial. They further understand that, in some instances, the costs of arbitration could exceed the costs of litigation and the right to discovery may be more limited in arbitration than in court.

If you purchase or access the Service through a third party service that provides a gateway to the Service, such as iTunes or Google Play (a “Gateway Service”), you will have a separate, additional account relationship with that Gateway Service and the information you provide to that Gateway Service will be handled in accordance with the privacy practices of the applicable Gateway Service. Gateway Services are not partners or representatives of Exit 7C and Exit 7C is not responsible for the acts or omissions of a Gateway Service with regard to the collection or use of your information.
Information that may be collected by cookies when you use the Service may include, without limitation:
You can set your browser to reject cookies or to notify you when you are sent a cookie. However, if you disable cookies you may not be able to use all features of the Service, including the features that are only made available to registered members of the Service.
We may also provide social media features through the Service that enable you to share information with your social networks and to interact with the Service on various social media sites. Your use of these features may result in the collection or sharing of information about you by these sites, depending on the feature. We encourage you to review the privacy policies and settings on the social media sites with which you interact to make sure you understand the information that may be collected, used, and shared by those sites.

In addition, if you access the Service through the Internet, your browser may allow you to adjust your browser settings so that “do not track” requests are sent to the websites that you visit. However, Exit 7C will not disable tracking technology that may be active on the Service in response to any “do not track” requests that we receive from your browser.

The protection and security of client data is our top priority.
We authenticate and encrypt all channels of communication connected to our servers and all data is encrypted with private keys. This means that no one else can ever see your data, unless you grant them permission to access it. Whether the data is coming from you, a third party provider, or from our systems, we secure your stored data to keep it private, safe, and secure. Exit 7C develops its software products in a manner consistent with PCI compliance.
Exit 7C uses the following techniques to secure all data:
All Exit 7C Software Products will require connecting machines or users to identify themselves and present credentials to validate their identity.
Exit 7C Software Products will grant machines or users access to resources as appropriate.
Exit 7C Software Products will keep an audit trail tracking all accesses to sensitive data.
Exit 7C Software Products will encrypt all sensitive data when transmitted on an untrusted connection and when stored in any database, log, or URL.
Exit 7C Software Products will transmit and store sensitive data with additional signatures and will check those signatures so that any tampering of sensitive data will be detected. Furthermore these software products will require sensitive data entered or modified by users to be explicitly signed by those users.

Information You Provide. The Exit 7C Website does not collect or solicit any personal information during use or access to the Exit 7C Website. However, you can provide to Exit 7C what is generally called “personally-identifiable” information (such as your name, email address, postal mailing address, and telephone numbers) only if you choose to contact Exit 7C from the website or by submitting your résumé for the open positions at Exit 7C listed under the “Careers” section of the Exit 7C Website.
“Cookies” Information. When you access the Exit 7C Website, we may send one or more cookies – small text files containing a string of alpha-numeric characters – to your computer. Exit 7C may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the Exit 7C Website. Persistent cookies can be removed. Please review your web browser “Help” file to learn the best way to modify your cookie settings.
“Automatically Collected” Information. When you access the Exit 7C Website we may automatically record certain information from your system by using different types of tracking technology. This “automatically collected” information may include Internet Protocol address (“IP Address”), versions of software installed, system type, the content and pages that you access on the Exit 7C Website, and the dates and times that you visit the Exit 7C Website.
We will not use, without your further consent, your email address or other contact information you may choose to provide when contacting Exit 7C via email, except to respond to your initial email.
Exit 7C uses all of the information that we collect to understand the usage trends and preferences of our Users, to improve the way the Exit 7C Website works and looks, and to create new features and functionality.
Exit 7C may use “Automatically Collected” information and “Cookies” information to: (a) automatically update the Exit 7C Website on your system; and (b) monitor aggregate site usage metrics such as total number of visitors and pages accessed.
Exit 7C may disclose User information if required to do so by law or in the good-faith belief that such action is necessary to comply with state and federal laws (such as U.S. copyright law) or respond to a court order, judicial or other government subpoena, or warrant in the manner required by the requesting entity.
Exit 7C also reserves the right to disclose User information that we believe, in good faith, is appropriate or necessary to take precautions against liability; protect Exit 7C from fraudulent, abusive, or unlawful uses; to investigate and defend ourselves against third-party claims or allegations; to assist government enforcement agencies; to protect the security or integrity of the Exit 7C Website; or to protect the rights, property, or personal safety of Exit 7C, our Users, or others.
If Exit 7C learns of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps. Exit 7C may post a notice on the Exit 7C Website if a security breach occurs. Depending on where you live, you may have a legal right to receive notice of a security breach in writing. Protecting the privacy of young children is especially important. For that reason, Exit 7C does not knowingly collect or maintain personally-identifiable information from persons under 13 years-of-age. If Exit 7C learns that personally-identifiable information of persons less than 13-years-of-age has been provided to Exit 7C, then Exit 7C will take the appropriate steps to delete this information.
If you are the parent or legal guardian of a child under 13 who has provided personal information to Exit 7C, then please contact Exit 7C at email@example.com to have that child’s information deleted.
